Does it cost anything to meet with you?
No. Initial consultations are
free of charge.
2. Do I pay you to represent me?
There is no upfront payment to
the firm. If we are successful in
representing you, we will then take the
firm’s fee- typically 1/3 of the
settlement amount plus expenses. If we
are not successful, there is no charge
to you.
3. If I am injured, is there a time
period in which I need to file a claim?
Delaware statute of limitations
for personal injury cases require that
you file a lawsuit within two years of
the date of the injury with certain
exceptions.
4. Is it hard to prove medical
malpractice?
It will be necessary for you to
prove that the medical care did not meet
the standard of care and that resulted
in proximate injury to you. We usually
ask potential clients to come in and
discuss what happened so that we can
start the process of determining whether
your medical provider did not meet the
standard of care. Before a lawsuit can
be filed, an Affidavit of Merit must be
obtained from a certified expert.
5. An insurance company has told me not
to hire a lawyer and that the insurance
company will be fair in settling my
claim. Is it in my interest to delay
hiring a lawyer?
Over 30 years of experience has
taught us that no insurance company
settles a claim fairly or for full value
unless a client is represented by an
attorney. The insurance industry is in
the business of making money. The less
they pay in regard to every claim that
is submitted the greater their profit at
the end of the year.
6. Why can’t I just negotiate myself
with the insurance company and save
money?
You can negotiate yourself, but
it is unlikely that you will maximize
your overall recovery.
7. How bad do my injuries need to be in
order to have an attorney represent me?
Any injury that has been caused
by the negligence of someone else is
worthy of a discussion.
8. Will my insurance rates go up after
an accident? Will my insurance company
drop me if I have an attorney that is
trying to get the most benefit from my
policy?
This is not a common result.
9. If you represent me, are we
definitely going to sue someone?
It is always the client’s
decision whether to negotiate or to file
a lawsuit.
